Definitions ### 1.1 FiberFS "FiberFS" means the software originally distributed by the Licensor under this License. ### 1.2 Licensor "Licensor" means FiberFS LLC and its successors and assigns. ### 1.3 Covered Software "Covered Software" means: 1) FiberFS; 2) any Derivative Work of FiberFS; 3) any modification, adaptation, enhancement, extension, translation, port, or fork of FiberFS; and 4) any work that incorporates any portion of FiberFS source code. ### 1.4 Derivative Work "Derivative Work" has the meaning provided by applicable copyright law. ### 1.5 System "System" means: 1) a physical computer, server, appliance, workstation, or device; or 2) a virtual machine that is assigned dedicated operating-system resources and executes Covered Software independently of another virtual machine. Containers, pods, processes, threads, and similar execution environments running on the same operating-system instance do not constitute separate Systems. For purposes of this License: * one physical host counts as one System; * each virtual machine counts as one System; * multiple containers running on the same operating-system instance count as one System; and * a System shall be counted only once regardless of the number of copies, instances, processes, services, mounts, volumes, filesystems, namespaces, tenants, users, applications, containers, or workloads utilizing Covered Software on that System. ### 1.6 Entity "Entity" means any individual or legal person, together with any affiliates controlling, controlled by, or under common control with such person. ## 2. License Grant Subject to this License, Covered Software may be: * used; * copied; * modified; * distributed; * sold; * incorporated into proprietary software; and * incorporated into commercial products. Source-code disclosure is not required. Private modifications are permitted. Commercial use is permitted. ## 3. License Continuity Every copy of Covered Software shall remain subject to this License. All distributions of Covered Software shall include a complete copy of this License. No person may use, copy, modify, distribute, sublicense, sell, operate, or otherwise make Covered Software available except subject to this License. No person may distribute Covered Software under terms that remove, modify, waive, replace, supersede, restrict, or conflict with this License. Deployment Threshold Covered Software may be operated on up to thirty-two (32) Systems per Entity without additional authorization. Operation of Covered Software on more than thirty-two (32) Systems is not authorized by this License. Before operating Covered Software on more than thirty-two (32) Systems, the Entity must enter into a separate written agreement with Licensor. More information is available at: https://fiberfs.io/license/ ## 5. License Scope The rights granted by this License extend only to deployments of thirty-two (32) Systems or fewer. Any operation of Covered Software in excess of that limit without a separate written agreement from Licensor constitutes use outside the scope of this License and is an infringement of the Licensor's rights. ## 6. Copyright Notice This License grants no rights to use the name "FiberFS", the FiberFS logo, any FiberFS trademarks, service marks, trade dress, branding, or other identifying marks, except for accurate attribution and preservation of notices required by this License. Except with the prior written permission of Licensor, no person may: 1) distribute a modified version, fork, derivative work, product, service, or commercial offering using the name "FiberFS" as its product name or branding; 2) represent that a product, service, fork, modification, or derivative work is endorsed by, sponsored by, affiliated with, certified by, or approved by Licensor; or 3) use any FiberFS trademark, logo, or branding in a manner likely to cause confusion regarding the origin of a product or service. Forks, modifications, and derivative works must use a name and branding that are clearly distinct from FiberFS. All distributions of Covered Software shall retain all copyright notices, license notices, and attribution notices present in the original FiberFS distribution. No person may remove or alter such notices. ## 7. Termination Any rights granted under this License terminate automatically upon a material violation of this License. Termination does not relieve any liability or obligation arising from acts or omissions occurring before termination. ## 8. Disclaimer of Warranty THE COVERED SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ## 9. Limitation of Liability IN NO EVENT SHALL THE LICENSOR OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, CLAIMS, OR OTHER LIABILITIES ARISING FROM OR RELATING TO THIS LICENSE OR THE COVERED SOFTWARE. ## 10. Entire License This License constitutes the complete agreement governing the use, modification, distribution, and operation of Covered Software, except to the extent Licensor has entered into a separate written agreement with the applicable person or Entity. Any separate written agreement signed by Licensor may grant additional rights, impose additional obligations, or supersede this License as expressly provided in that agreement. ## 11. No Waiver Failure of the Licensor to enforce any provision of this License shall not constitute a waiver of any future enforcement of that provision or any other provision. ## 12. Governing Law This License and any dispute, claim, or controversy arising out of or relating to this License or the Covered Software shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles.
